Can a “Stacked Supreme Court” Do its Job?

Let’s begin with what I love most: the truth. Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh are unfit to be Justices on the Supreme Court. If you did not watch or read the details of their confirmation hearings you would not understand why. The one person who is most infamous is Kavanaugh, and because his confirmation occurred just months ago, you may remember how Moscow Mitch McConnell and his cowardly party bowed once again to Trump and allowed a totally unfit man to sit on our nation’s highest court.

Few Americans understand the importance of the Supreme Court and even fewer understand its function as designed by the Constitutional Convention in 1787.

America’s ‘check and balance system’ was almost perfect; at least originally. Three ‘separate but equal branches’ would ensure that a democracy would be sustainable. The executive branch would include a president and his administration. He would be the commander-in-chief of the military; be the nation’s chief diplomat in foreign relations; and have veto rights over laws passed by congress; among other responsibilities. The legislative branch has the power to create laws; the power to declare war; and other related powers. Congress can also override a president’s veto with a two-thirds majority; with the purpose of preventing the rule of America by a monarch. The judicial branch is the Supreme Court. Its sole function is to protect the Constitution; ensuring that policies and laws comply with the Law of the Land.

Moscow Mitch McConnell blocked the nomination of Merrick Garland for the opening on the Court created by the death of Anton Scalia during President Obama’s administration. He refused to allow hearings in the senate. After Trump was illegitimately elected, Moscow Mitch and Trump pushed through the nomination of right-wing extremist, Neil Gorsuch. The Court was now fairly balanced, with Justice Anthony Kennedy as a frequent ‘swing’ voter. When he retired, at the urging of Trump, Brett Kavanaugh was nominated.

Although he had been charged with past actions which could be labeled as “sexual assault,” he was confirmed by Moscow Mitch’s pawns. The Court is now split 5-4 with right wing extremists dominating all future decisions.

Justice Sonia Sotomayor was nominated by President Barrack Obama. In a recent decision by the Court, a new Trump rule, which prevents low-income men and women from immigrating to America, was upheld by the five right-wing justices and rejected by the four remaining members of the Court. Sotomayor is very upset; believing that the rule is unconstitutional.

She claims that this action is tantamount to “putting a thumb on the scale in favor of” the Trump administration.

“It is hard to say what is more troubling,” Sotomayor wrote. “That the government would seek this extraordinary relief seemingly as a matter of course, or that the Court would grant it.”

Stacking the Court with right-wing extremists is another effort by Trump and Moscow Mitch to replace democracy with fascism.

The Constitution must apply equally in all situations. If it does not, it becomes nothing more than an old piece of parchment. The Court is not doing their job. It has become politicized, which is in direct opposition to the intent of our founding fathers. The executive and legislative branches are obviously products of political views, but the Court must be concerned with one, and only one situation; rules, policies, executive orders, and laws must follow the words written by our nation’s founders 211 years ago.

Finally, the truth. If the issue involved guns or gun laws, Republicans would be screaming about the second amendment. This is what the NRA gun lobby orders them to do. When it involves ‘doing the right thing,’ they simply don’t care.
